TERMS AND CONDITIONS OF SALE

LAPLACE – AUBERGE LA PLACE
Accommodation • Restaurant • Spa Apoticari
Version applicable as of September 1, 2026

PREAMBLE

These General Terms and Conditions of Sale, hereinafter the "T&Cs," govern the contractual relationship between:

AUBERGE LA PLACE, a simplified joint-stock company with a capital of 1,000 euros, registered with the Trade and Companies Register of Le Puy-en-Velay under number 106 572 274, with its registered office located at 12 rue Traversière des Mourgues, 43000 Le Puy-en-Velay, intra-community VAT number FR81106572274,

hereinafter referred to as the "Operator,"

operating the establishment under the brand name Laplace,

and any individual or legal entity making a reservation with Laplace, hereinafter referred to as the "Client."

Located in the heart of the historic center of Le Puy-en-Velay, Laplace brings together several distinct activities: five furnished rooms for short-term tourist accommodation, a restaurant, and a wellness area operated under the brand name Spa Apoticari.

Rooms are available for individual booking. They are intended exclusively for the temporary accommodation of transient guests who do not establish residency there.

These T&Cs set out the conditions applicable to reservations made directly with Laplace, including via the establishment's website, through the integrated booking engine, by email, or by telephone.

Certain provisions of these T&Cs, particularly those relating to stay conditions, room occupancy, guest conduct, damages, and services consumed on-site, also apply to Clients who have booked through a third-party platform, provided they are not incompatible with that platform's contractual terms.

PART I – GENERAL PROVISIONS

ARTICLE 1 – DEFINITIONS

For the purposes of these T&Cs, the following terms have the meanings defined below:

"Room" : one of the five furnished accommodation units available for individual booking at Laplace.

"Guest" : any person making a booking or receiving a service offered by Laplace.

"Operator" : the company AUBERGE LA PLACE.

"Establishment" or "Laplace" : refers, depending on the context, to the spaces and activities operated by AUBERGE LA PLACE under the Laplace brand.

"Booking" : any firm order for a Room or a service offered by Laplace and confirmed by the Operator.

"Stay" : the period between the arrival date and the departure date indicated in the booking confirmation.

"Site" : the official Laplace website and its integrated booking engine.

"Partner Platform" : any third-party platform used to book a Room, including but not limited to Booking.com or Airbnb.

"Spa" : the wellness area operated within Laplace under the Spa Apoticari brand.

ARTICLE 2 – PURPOSE AND SCOPE

These Terms and Conditions define the respective rights and obligations of the Operator and the Guest regarding the booking and provision of services offered by Laplace.

These apply to bookings made directly with Laplace via the Site, the booking engine integrated into the Site, email, or telephone.

Any booking implies that you have read and accepted these Terms and Conditions without reservation, as well as the specific conditions attached to the selected rate or service.

For bookings made through a partner platform, the pricing, payment, modification, and cancellation terms presented and accepted on that platform shall prevail if they differ from these Terms and Conditions.

The rules regarding room occupancy, safety, guest conduct, damages, on-site services, and house rules remain applicable throughout the stay, regardless of the booking channel.

ARTICLE 3 – CUSTOMER CAPACITY

The Customer declares that they have the legal capacity to enter into this contract.

A Customer making a booking on behalf of other guests agrees to inform them of these Terms and Conditions and is responsible for ensuring that all guests comply with the obligations related to the stay.

Minors may not book or occupy a room alone.

ARTICLE 4 – PRE-CONTRACTUAL INFORMATION

Before making any booking, the Customer acknowledges having had access to essential information regarding the selected service, including its main features, price, stay dates, room capacity, included services, and applicable payment, modification, and cancellation terms.

The photographs, floor plans, illustrations, and representations on the Site are intended to present the rooms and spaces at Laplace as accurately as possible. However, slight variations may occur, particularly due to the configuration of an old building or changes in decor, furniture, or equipment.

The essential characteristics of the booked room category are guaranteed.

PART II – ACCOMMODATION

ARTICLE 5 – ROOM BOOKING

5.1 Booking methods

Rooms can be booked:

  • on the Laplace website via the integrated booking engine;
  • by email;
  • by telephone;
  • through a partner platform.

All bookings are subject to availability.

5.2 Formation of the contract

A booking becomes firm once a booking confirmation has been sent to the Client by email and, where payment or a bank guarantee is required, once it has been validated.

The confirmation specifies, in particular, the dates of the stay, the Room or category booked, the number of occupants, the price, and the applicable rate conditions.

The Client must immediately check the information on this confirmation and report any errors without delay.

5.3 Accuracy of information

The Client guarantees the accuracy of the information provided at the time of booking, including their identity, contact details, the number and identity of the occupants, and the information required for payment.

Laplace may refuse or cancel a booking containing information that is clearly incorrect, incomplete, or fraudulent.

5.4 Privatization

Subject to availability, all five Rooms may exceptionally be booked or privatized as a whole.

Specific conditions, particularly regarding rates, payment, capacity, and cancellation, may then be established and shall prevail over these Terms and Conditions in the event of a contradiction.

ARTICLE 6 – PRICE

Prices are indicated in euros, inclusive of all taxes, based on the VAT rate applicable on the date of the booking.

The applicable price is the one displayed and accepted at the time of booking.

Unless otherwise indicated at the time of booking, the Room price includes:

  • the overnight stay;
  • bed linen and towels;
  • end-of-stay cleaning;
  • breakfast served at Restaurant Laplace.

Additional services, such as minibar consumption, restaurant, drinks, Spa treatments, or other services ordered during the stay, are charged as extras.

The applicable tourist tax is not included in the rate when it must legally be collected separately. It is calculated in accordance with the current rate set by the competent local authority and paid by the Guest according to the terms indicated during booking or the stay.

Any creation or modification of a tax or contribution legally applicable between the time of booking and invoicing may be passed on in accordance with regulations.

ARTICLE 7 – RATE CONDITIONS

7.1 Flexible Rate

Unless different specific conditions are expressly indicated at the time of booking, the Flexible Rate is guaranteed by a valid bank card.

The booking may be cancelled or modified free of charge up to seven calendar days before the scheduled arrival date.

After this period, the total amount of the booked stay is due.

Any modification remains subject to availability and the rates applicable to the new requested dates.

A modification resulting in a price increase requires payment of the corresponding difference. A modification resulting in a price decrease is handled in accordance with the rate conditions applicable to the modified booking.

7.2 Non-refundable Rate

When the Guest selects a rate expressly presented as "Non-refundable," the total amount of the stay is charged at the time of booking.

This rate is not subject to any cancellation, modification, or refund at the Guest's initiative, except as otherwise required by mandatory legal provisions or express commercial agreement from Laplace.

7.3 Specific conditions

Laplace may occasionally offer deals, packages, or rates that include specific payment, modification, or cancellation conditions.

These conditions are communicated to the Guest before the booking is confirmed and take precedence over this article in the event of a contradiction.

ARTICLE 8 – PAYMENT AND BANK GUARANTEE

The accepted payment methods are those indicated to the Guest during booking or on-site.

For bookings requiring a bank guarantee, the Guest must provide the details of a bank card that is valid until the end of the stay.

Laplace may process a bank pre-authorization under the conditions announced to the Client.

Unless paid in advance or subject to specific pricing terms, the price of the stay and any additional services is due no later than the time of departure.

Laplace may request, before or at the time of arrival, a bank pre-authorization of 300 euros per Room intended to guarantee any amounts that may be owed for the stay.

This pre-authorization does not constitute a payment.

It may, in particular, cover unpaid charges, damages, loss or disappearance of items, costs for replacing keys or equipment, exceptional cleaning fees, or any other amount for which the Client is contractually liable.

When the cost of the damage exceeds the amount of the guarantee, Laplace reserves the right to claim payment of the difference from the Client upon presentation of documentation establishing the amount.

ARTICLE 9 – CANCELLATION AND MODIFICATION

Any request to cancel or modify a direct booking must be sent to Laplace by email or by any other means that provides a record of the request.

The date on which the request is received by Laplace determines the application of the cancellation terms.

The terms stated in the booking confirmation shall prevail if they differ from the general terms and conditions set out in Article 7.

Bookings made through a partner platform must, if required by that platform, be modified or cancelled directly through them.

ARTICLE 10 – NO RIGHT OF WITHDRAWAL

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal applicable to certain distance contracts cannot be exercised for accommodation services, other than residential accommodation, that are to be provided on a specific date or at a specific frequency.

The Client therefore does not benefit from a fourteen-day cooling-off period for accommodation bookings made for specific dates.

ARTICLE 11 – NO-SHOW AND INTERRUPTION OF STAY

11.1 No-show

Failure of the Client to arrive on the scheduled date, without prior cancellation in accordance with the applicable pricing terms, constitutes a "no-show."

In the event of a no-show, 100% of the total booking amount is due..

If the Guest does not inform Laplace of a delayed arrival, Laplace may make the room available to other guests starting from the day after the originally scheduled arrival date, without any right to a refund.

11.2 Early departure

Any interruption or early departure decided by the Guest will not result in any refund for unused nights or services, unless otherwise agreed in writing by Laplace or required by mandatory legal provisions.

ARTICLE 12 – ARRIVAL

Arrivals are scheduled every day between 3:30 PM and 7:00 PM.

As Laplace does not have a 24-hour reception, check-in is by appointment.

Guests are requested to provide their estimated time of arrival before the start of their stay.

Any arrival scheduled after 7:00 PM must be communicated to Laplace in advance.

Late arrival may be arranged subject to staff availability. This may incur additional charges if it requires special arrangements or staff presence. The amount of any such fees will be communicated to and accepted by the Guest before the late arrival is confirmed.

If the Guest fails to provide information and it is not physically possible to arrange their check-in, Laplace cannot guarantee access to the room that same evening.

ARTICLE 13 – DEPARTURE

The room must be vacated no later than 11:30 AM on the day of departure.

Late departure may be arranged upon request, subject to availability and express approval from Laplace.

This may incur an additional charge, the amount of which will be communicated to the Guest before the late departure is confirmed.

Remaining in the room beyond the departure time without authorization from Laplace may result in charges for costs and damages incurred, particularly if the delay prevents or disrupts the arrival of subsequent guests.

ARTICLE 14 – CAPACITY AND OCCUPANCY

Each room is designed to accommodate a maximum of two people.

One child under the age of three may be added to the two occupants if sleeping in a crib provided free of charge by Laplace, subject to prior request and availability.

No extra beds or additional sleeping arrangements for an adult or a child aged three or older may be provided.

A child or teenager may occupy one of the two sleeping spots in a room when accompanied by a responsible adult.

The number of occupants may under no circumstances exceed the authorized capacity of the room.

Only persons registered with Laplace are permitted to stay overnight in the room.

It is prohibited to assign, sublet, or make all or part of the room available to a third party, whether free of charge or for a fee.

ARTICLE 15 – DURATION OF STAY AND USE OF PREMISES

The rooms are intended exclusively for temporary tourist stays.

Unless otherwise expressly agreed by Laplace, a reservation may not exceed thirty consecutive nights.

The room may not constitute the Client's primary or secondary residence, domicile, registered office, or place of business.

The Client may not conduct any commercial, professional, or illicit activity therein.

ARTICLE 16 – HOUSE RULES

The Client agrees to use the room, its equipment, and the areas to which they have access in a peaceful manner and in accordance with their intended purpose.

Specifically prohibited are:

  • parties, gatherings, receptions, or events not expressly authorized;
  • noise disturbances or behavior likely to disrupt the tranquility of other occupants, neighbors, or users of Laplace;
  • overnight stays by unregistered persons;
  • photo shoots, filming, or the production of commercial, advertising, or professional content without prior written authorization from Laplace;
  • any commercial or professional activity organized from the Room;
  • food or beverage deliveries from external delivery services or establishments, including platforms such as Uber Eats, Deliveroo, or equivalent;
  • the introduction or use of substances or products prohibited by law;
  • any behavior contrary to public order, the safety of individuals, or the tranquility of the premises.

Occasional visitors are subject to Laplace's approval and are under no circumstances permitted to spend the night in the Room without prior registration.

Any serious or repeated breach may result in the early termination of the stay, without prejudice to the payment of services already consumed, contractually due amounts, and compensation for any damages caused.

ARTICLE 17 – NO SMOKING POLICY

Smoking or vaping is strictly prohibited in the Rooms and in all indoor areas not expressly designated for this purpose.

In the event of non-compliance, Laplace may charge the Client for the costs effectively incurred to restore the Room or the affected areas to a condition suitable for normal use, including costs for deep cleaning, deodorization, textile treatment, replacement of damaged items, or, where applicable, the consequences directly attributable to the temporary unavailability of the Room.

These amounts may be deducted from the bank guarantee provided for in Article 8 or be subject to additional invoicing if they exceed the amount of the guarantee.

The unjustified triggering of a security device, detector, or alarm, or any such triggering resulting from the Client's behavior, may also result in the invoicing of the costs directly incurred.

ARTICLE 18 – PETS

Pets are not permitted in the Rooms or in Laplace's accommodation areas, regardless of their size.

This prohibition does not apply to legal provisions regarding guide dogs for the blind and assistance dogs accompanying the individuals who require them.

The Client is requested to inform Laplace of their presence at the time of booking so that appropriate arrangements can be made.

ARTICLE 19 – HOUSEKEEPING, LINEN, AND ROOM MAINTENANCE

The price of the stay includes the provision of bed linen and towels, as well as end-of-stay cleaning.

Unless a specific service is expressly offered or agreed upon with the Client, Laplace does not provide daily housekeeping for the Room during the stay.

The Guest is required to keep the Room in a reasonable state of cleanliness throughout their stay and to use it only for its intended purpose.

If the condition in which the Room is left upon departure clearly exceeds the consequences of normal use and requires exceptional cleaning, Laplace may charge the Guest for the additional cleaning costs actually incurred.

It is strictly forbidden to remove linens, towels, bathrobes, accessories, decorative items, or equipment provided in the Room from the establishment.

ARTICLE 20 – DAMAGE, LOSS, BREAKAGE, AND THEFT OF ITEMS

The Guest is responsible for the Room, its furniture, its equipment, and the items provided therein for the entire duration of their stay.

The Guest is liable for any damage caused by themselves as well as by any persons occupying or visiting the Room under their responsibility.

Any damage, deterioration, breakage, loss, or disappearance noted and attributable to the Guest may result in a charge equal to the actual cost of repair, restoration, or replacement.

This provision applies in particular, but is not limited to:

  • furniture;
  • lighting fixtures;
  • sanitary fixtures;
  • electrical and electronic equipment;
  • bedding;
  • household linens;
  • accessories;
  • keys or other access devices;
  • artwork, decorative objects, and furnishings;
  • any equipment or item made available to the Guest.

If the damaged or missing item is artisanal, antique, unique, or no longer commercially available, the amount claimed may correspond to the reasonable cost of its restoration or replacement with an item of comparable nature and quality.

Laplace may deduct these amounts from the security deposit provided for in Article 8 or request direct payment from the Guest.

When damage results in the temporary inability to rent out the Room, Laplace may also seek compensation for the direct and justifiable loss resulting therefrom.

The Guest is encouraged to report any anomaly, deterioration, or malfunction as soon as it is discovered to avoid being held responsible for pre-existing damage.

ARTICLE 21 – PERSONAL EFFECTS AND VALUABLES

The Guest remains responsible for their personal effects throughout the duration of their stay.

It is the Guest's responsibility to take appropriate precautions regarding cash, jewelry, electronic devices, identity documents, and other valuables.

Laplace cannot be held liable for the loss, misplacement, deterioration, or disappearance of personal effects in cases where its liability is not legally engaged.

Any item found after departure may be kept temporarily by Laplace.

Upon the Guest's request, shipping can be arranged at the Guest's expense and risk, according to terms agreed upon with Laplace.

Unclaimed items will be handled in accordance with applicable regulations.

ARTICLE 22 – LUGGAGE

Subject to storage capacity and prior agreement, Laplace may agree to temporarily store a Guest's luggage before their arrival or after their departure.

This service is offered upon request and is not a service automatically included in the booking.

Luggage must be properly closed and must not contain any dangerous, illicit, or perishable products, or items requiring special storage conditions.

Cash, jewelry, securities, important documents, and other valuables must remain in the Guest's possession.

ARTICLE 23 – MINIBAR AND IN-ROOM CONSUMPTION

Rooms may be equipped with a minibar containing drinks and products available for purchase.

Applicable prices are indicated in the room or brought to the Guest's attention by any other appropriate means.

All consumption is payable by the Guest and may be charged to their account to be settled no later than at the time of departure.

If consumption is discovered after departure and has not been paid for, Laplace may request payment from the Guest and, under the conditions authorized by the payment provider and previously accepted by the Guest, process payment using the guarantee method associated with the booking.

Any alcoholic beverages present in the minibar are intended exclusively for adults. The sale or provision of alcoholic beverages to minors is prohibited.

ARTICLE 24 – BREAKFAST

Unless otherwise expressly stated at the time of booking, breakfast is included in the room rate.

It is served at Restaurant Laplace, generally between 8:00 AM and 10:00 AM.

The Guest is invited to inform Laplace, prior to arrival or as soon as possible, of any known food allergies or intolerances.

Laplace strives to accommodate special dietary requests brought to its attention but cannot guarantee the availability of specific products or the absolute absence of traces of allergens in a dining environment that uses various ingredients.

Breakfast not consumed by the Guest does not entitle them to any price reduction or refund.

ARTICLE 25 – PARKING AND ACCESS

Laplace is located in the historic center of Le Puy-en-Velay, in an area that includes restricted traffic or pedestrian zones.

Laplace does not have private parking included with room bookings.

Public parking spaces and lots are available nearby, subject to the access conditions, hours, and rates set by their respective operators.

Laplace can provide the Guest with practical information regarding parking options but does not guarantee their availability or operating conditions.

Vehicles parked on public roads or in third-party parking facilities remain the responsibility of their owner or user.

Laplace cannot be held liable for theft, damage, fines, towing, or other events affecting a vehicle parked outside its premises.

ARTICLE 26 – ACCESSIBILITY AND BUILDING CHARACTERISTICS

Laplace is housed in a historic building located in the old town center of Le Puy-en-Velay.

The building's architectural layout may include stairs, changes in floor levels, narrow passages, or other features typical of an old property.

Any guest with specific mobility or accessibility requirements is encouraged to contact Laplace before booking to obtain precise information regarding the room and areas in question.

Upon request, Laplace will provide the guest with details regarding its accessibility features to help them determine if the accommodation meets their needs.

ARTICLE 27 – SAFETY AND CONDUCT

Guests must comply with all safety instructions provided, as well as respect the equipment and devices installed throughout the establishment.

It is strictly prohibited to tamper with, move, cover, damage, or unnecessarily handle smoke detectors, fire extinguishers, alarm systems, or any other safety equipment.

Guests must not bring any appliance or material into their room that poses a specific risk to people, property, or the building.

The use of personal cooking appliances, candles, incense, open flames, or any devices that could potentially cause a fire is prohibited in the rooms.

In the event of an emergency, a risk to the safety of people or property, suspected damage, or urgent technical necessity, Laplace reserves the right to enter the room, even in the guest's absence, to the extent strictly required by the situation.

PART III – RESTAURANT LAPLACE

ARTICLE 28 – RESTAURANT RESERVATIONS

Reservations for Restaurant Laplace can be made through the channels offered by the establishment, including directly with Laplace by phone, email, via the website, or, where applicable, through a partner booking service.

All reservations are subject to restaurant availability.

The guest agrees to provide accurate contact information and the exact number of guests expected.

Laplace reserves the right to contact the guest to confirm their reservation.

In case of delay, the guest is asked to notify the restaurant as soon as possible. If no notice is given and after a reasonable amount of time relative to the current service, Laplace may consider the reservation a no-show and release the table.

For certain reservations, such as groups, private events, special menus, or specific occasions, Laplace may require a credit card guarantee, a deposit, or prepayment. The corresponding terms will be communicated to the guest before the reservation is confirmed.

ARTICLE 29 – CANCELLATION, DELAY, AND NO-SHOWS AT THE RESTAURANT

When a restaurant reservation does not require a credit card guarantee, prepayment, or specific terms, the guest is asked to notify Laplace as soon as possible in the event of a cancellation or a change in the number of guests.

When a credit card imprint, guarantee, deposit, down payment, or prepayment is required, the applicable cancellation and no-show policies will be communicated to the Client at the time of booking and must be expressly accepted before confirmation.

Unless specific terms are communicated at the time of booking, a guaranteed reservation may be cancelled or modified free of charge up to 24 hours before the scheduled reservation time.

In the event of cancellation less than 24 hours before the scheduled time or a no-show without prior cancellation, Laplace may apply the reservation or no-show fees announced and accepted at the time of booking.

In the event of a significant reduction in the number of guests without prior notice, Laplace may apply the terms corresponding to the number of covers initially reserved, where this has been provided for and accepted at the time of booking.

Significant delays may result in the table being released if service constraints no longer allow the reservation to be held. The Client is therefore requested to notify Laplace of any delay as soon as they become aware of it.

ARTICLE 30 – PRICES AND PAYMENT AT THE RESTAURANT

The prices for dishes, menus, drinks, and other services are those appearing on the menus or materials presented to the Client at the time of ordering.

They are expressed in euros, inclusive of all taxes, according to the applicable VAT rates.

Payment is made at the end of the meal, unless prepayment or specific terms were agreed upon at the time of booking.

For Clients staying in a Room, Laplace may authorize the charging of all or part of the Restaurant expenses to the Room account.

This option remains subject to Laplace's approval. The amounts charged in this way are due no later than the time of departure.

ARTICLE 31 – ALLERGIES, INTOLERANCES, AND DIETARY REQUIREMENTS

The Client is requested to inform the Restaurant, at the time of booking and again when ordering, of any food allergy or intolerance that may affect their meal.

Regulatory information regarding allergens present in preparations is made available in accordance with applicable regulations.

Laplace strives, as far as possible, to adapt certain preparations to dietary requirements notified sufficiently in advance.

However, given the use of numerous ingredients in the same kitchen environment, Laplace cannot guarantee the absolute absence of traces or cross-contamination, unless expressly stated otherwise regarding a specific preparation.

Dietary preferences or specific diets that do not involve an allergy may be accommodated within the limits of the Restaurant's capabilities and provided they have been communicated sufficiently in advance.

ARTICLE 32 – CONDUCT AT THE RESTAURANT

The Client must behave in a manner consistent with the tranquility, safety, and proper operation of the Restaurant.

Laplace may refuse to serve alcohol to any minor or anyone who is visibly intoxicated and reserves the right to request proof of age as provided by law.

Any behavior that is violent, threatening, abusive, dangerous, or seriously disruptive to other guests or staff may lead Laplace to ask the individual concerned to leave the premises, without prejudice to the payment of any drinks already ordered or served.

PART IV – SPA APOTICARI

ARTICLE 33 – SPA ACCESS FOR OVERNIGHT GUESTS

Guests staying in a room may enjoy access to the Spa Apoticari sensory pool and sauna at no extra charge when included in their booking.

This access is offered exclusively by reservation and subject to availability.

Booking a room does not guarantee Spa availability at the guest's preferred time.

The unavailability of a specific time slot shall not entitle the guest to a room rate reduction or any form of compensation.

Spa access is reserved for individuals aged 18 or older.

Guests must adhere to their assigned time slot and follow the hygiene, safety, and usage guidelines provided by Laplace.

ARTICLE 34 – SPA TREATMENTS AND SERVICES

Massages, treatments, and other services offered by Spa Apoticari are not included in the room rate, unless an offer or package expressly states otherwise.

They are provided by reservation only and are subject to availability.

The stated durations correspond to the scheduled length of the service as communicated to the guest.

Before receiving a treatment, the Client is required to provide any information necessary for its proper performance and to inform the practitioner of any known contraindications or specific circumstances that might affect the service.

Treatments offered by Spa Apoticari are for wellness and comfort purposes and do not constitute medical or therapeutic procedures.

ARTICLE 35 – CANCELLATION AND LATE ARRIVAL FOR TREATMENTS

Unless otherwise specified at the time of booking, a treatment service may be cancelled or rescheduled free of charge up to 24 hours before the scheduled time.

In the event of a cancellation less than 24 hours before the appointment or a no-show, Laplace reserves the right to charge 100% of the price of the booked service, provided that this condition was brought to the Client's attention at the time of booking.

In the event of the Client's late arrival, Laplace will make every effort to provide the service.

However, when scheduling constraints require it, the duration of the treatment may be reduced so as not to penalize subsequent appointments, without any price reduction when the delay is attributable to the Client.

When the delay no longer allows for the service to be performed reasonably, it may be treated as a no-show.

ARTICLE 36 – SPA USE AND SAFETY

Use of the sensory pool, sauna, and other Spa facilities must be in accordance with the instructions posted or provided by the team.

The Client must assess their own ability to use the facilities based on their personal situation and should seek medical advice if there is any doubt regarding their compatibility with their health condition.

Any use contrary to the instructions, or any dangerous behavior likely to compromise the safety or tranquility of other users, may result in immediate termination of Spa access.

For reasons of safety, hygiene, maintenance, or in the event of a technical incident, Laplace may temporarily close all or part of the Spa facilities.

PART V – GENERAL PROVISIONS

ARTICLE 37 – OPERATOR LIABILITY

Laplace is committed to performing the booked services in accordance with the essential characteristics presented to the Client and the applicable legal obligations.

The Operator's liability can only be engaged under the conditions provided for by applicable French law.

Laplace shall not be held liable for any damage resulting from the Client's fault or negligence, the unforeseeable and unavoidable act of a third party to the contract, an event of force majeure, or any circumstance reasonably beyond its control, subject to applicable mandatory legal provisions.

In particular, Laplace shall not be held liable for any damage resulting from:

  • the Client's failure to comply with these Terms and Conditions, safety instructions, or rules for the use of equipment;
  • abnormal or non-compliant use of the Rooms, the Spa, or other areas made available;
  • erroneous, incomplete, or late information provided by the Client when such information was necessary for the proper performance of the service;
  • an event attributable to a third-party provider or service chosen directly by the Client and not falling under the responsibility of Laplace;
  • a temporary interruption or disruption of a service provided by an external operator, particularly telecommunications, electricity, or water networks, when it does not result from a fault attributable to Laplace;
  • restrictions on traffic, parking, or access to the historic center decided by a public authority independent of Laplace.

Laplace shall take all reasonably necessary steps to remedy, as soon as possible, any malfunctions affecting a service when they are reported during the stay.

In this regard, the Client is invited to immediately report any malfunction, anomaly, or defect observed to Laplace to allow the Operator to intervene and, where possible, remedy it during the stay.

Nothing in these Terms and Conditions shall have the purpose or effect of excluding or limiting any liability that cannot be legally excluded or limited.

ARTICLE 38 – UNAVAILABILITY OF A ROOM OR SERVICE

In the event that it is impossible to provide the reserved Room due to an event attributable to Laplace, the Operator shall inform the Client as soon as possible.

Where reasonably possible, Laplace will offer a replacement solution with comparable characteristics or a change in the dates of the stay.

The Client remains free to accept or refuse the proposed solution.

When no acceptable solution can be implemented, the sums paid for the service that Laplace is unable to provide shall be refunded to the Client, without prejudice to any rights the Client may have under mandatory legal provisions.

Unlike a hotel establishment with a network or rehousing capacity, Laplace does not guarantee the ability to offer replacement accommodation in another establishment.

The occasional unavailability of an ancillary service that was not expressly guaranteed at the time of booking, such as a specific time slot at the Spa, does not constitute unavailability of the Room.

ARTICLE 39 – FORCE MAJEURE

Neither party shall be held liable for any failure or delay in the performance of all or part of its obligations when such failure or delay results from an event meeting the conditions of force majeure within the meaning of Article 1218 of the French Civil Code and French case law.

The party invoking an event of force majeure must notify the other party as soon as possible after becoming aware of it.

When the impediment is temporary, the performance of the obligation in question is suspended for the duration of the impediment, unless the resulting delay justifies termination of the contract.

When the impediment is permanent and makes performance of the service impossible, the contract may be terminated as of right under the conditions provided for by applicable law.

The financial consequences of an event of force majeure are determined in accordance with applicable legal provisions and the nature of the services concerned.

ARTICLE 40 – THIRD-PARTY PROVIDERS AND SERVICES

Laplace may provide the Client with information regarding services offered by third parties, such as public parking, taxis, transportation, tourist activities, tours, shops, or other local providers.

Except where Laplace is expressly acting as a seller, agent, or intermediary for the service in question, this information is provided for guidance only.

Any contract concluded between the Client and a third-party provider remains independent of the contract concluded with Laplace.

Laplace is not responsible for the performance of any service directly booked and contracted by the Client with an independent third party.

Booking platforms such as Booking.com or Airbnb remain responsible for the services they provide directly to the Client in accordance with their own contractual terms.

ARTICLE 41 – COMPLAINTS

Any difficulty encountered during the stay or while a service is being provided must, as far as possible, be reported immediately to the Laplace team so that a solution can be sought while the service is still ongoing.

Any complaint made after the service has been completed must be sent in writing to:

AUBERGE LA PLACE – Laplace
12 rue Traversière des Mourgues
43000 Le Puy-en-Velay
France

or by email to the contact address indicated on the Site.

The complaint must specify the Client's contact details, booking references, relevant dates, the subject of the complaint, and, where relevant, be accompanied by supporting documentation for review.

Laplace undertakes to review all complaints received and to respond within a reasonable timeframe.

Failure to report an issue during your stay when an immediate intervention could have reasonably resolved it may be taken into account when assessing a claim, without depriving the Client of their rights under the law.

ARTICLE 42 – CONSUMER MEDIATION

In accordance with Articles L.611-1 et seq. of the French Consumer Code, a Client who is a consumer may use a consumer mediator free of charge for the amicable resolution of a dispute with the Operator.

Recourse to a mediator may only be sought after the Client has first submitted a written complaint to Laplace and this process has failed to resolve the dispute.

The contact details for the consumer mediator relevant to AUBERGE LA PLACE will be provided to the Client in accordance with regulations and will be stated on the Site as well as in the final version of these Terms and Conditions.

The Client remains free to accept or refuse mediation and retains the right to bring the matter before the competent courts.

ARTICLE 43 – PERSONAL DATA

As part of its accommodation, catering, and wellness activities, AUBERGE LA PLACE collects and processes personal data concerning its Clients.

Such processing may include, but is not limited to:

  • managing requests and bookings;
  • preparing and carrying out stays and services;
  • managing payments and invoicing;
  • managing specific requests made by the Client;
  • managing the relationship with the Client before, during, and after the service;
  • handling complaints and potential disputes;
  • complying with the Operator's legal and regulatory obligations;
  • subject to the Client's consent where required, sending information and commercial communications.

Information required for booking or providing a service is identified as such at the time of collection.

If this information is not provided, Laplace may be unable to process the request or perform the service in question.

Data may be shared, to the extent necessary for their tasks, with service providers acting on behalf of the Operator, including providers for booking, payment, IT hosting, communication, or technical management.

When a booking is made through a partner platform, that platform also processes certain personal data in accordance with its own privacy policy and under its own responsibility for the processing activities it carries out.

Data is retained for the periods necessary for the purposes for which it was collected, as well as for the retention periods required or permitted by applicable law.

In accordance with Regulation (EU) 2016/679 of April 27, 2016, known as the General Data Protection Regulation, and the amended French Data Protection Act, any data subject has the right, under the conditions provided by law, to access, rectify, erase, limit, and object to the processing of their data, as well as the right to data portability where applicable.

Where processing is based on consent, it may be withdrawn at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

The Client may exercise their rights by contacting AUBERGE LA PLACE using the contact details provided on the Site or at the registered office address:

AUBERGE LA PLACE
12 rue Traversière des Mourgues
43000 Le Puy-en-Velay
France

The Client also has the right to lodge a complaint with the Commission nationale de l’informatique et des libertés (CNIL).

A separate privacy policy may supplement these provisions and specify, in particular, the processing carried out via the Site, the corresponding legal bases, retention periods, and any cookies or trackers used.

ARTICLE 44 – TELEPHONE SOLICITATION

When Laplace collects a Client's phone number, the Client is informed of their right to register free of charge on the telephone solicitation opt-out list provided for by applicable regulations.

This provision does not prevent communications necessary for the management of a booking, a stay, an appointment, or an ongoing service.

ARTICLE 45 – PROOF AND ELECTRONIC COMMUNICATIONS

The Client acknowledges that electronic exchanges with Laplace may serve as evidence of communications, bookings, modifications, and agreements reached between the parties under the conditions provided by applicable law.

Information recorded in the booking and payment systems used by Laplace may be stored and used as evidence of transactions performed, subject to the Client's right to challenge their accuracy by any means.

The booking confirmation, the rate conditions accepted by the Client, and the version of these Terms and Conditions applicable on the day of the booking constitute the primary contractual documents relating to a direct booking.

The Client is responsible for the accuracy of the email address and contact details provided and must inform Laplace of any changes that might prevent the receipt of communications regarding their booking.

ARTICLE 46 – RETENTION OF CONTRACTUAL DOCUMENTS

Laplace retains contractual documents and information related to bookings for the periods required or permitted by applicable laws and regulations, particularly in commercial, accounting, tax, and consumer protection matters.

When regulations require the Operator to retain a contract concluded electronically and to guarantee the Client access to it for a specific period, Laplace fulfills this obligation in accordance with applicable legal conditions.

ARTICLE 47 – INTELLECTUAL PROPERTY

The names, trademarks, logos, photographs, texts, illustrations, graphic designs, visual elements, content, and other distinctive signs used by Laplace or Spa Apoticari are protected, where applicable, by the intellectual property rights of their respective owners.

Their presence on the Site, in the establishment, or on any communication medium does not grant the Client any right of reproduction, representation, adaptation, or exploitation.

Any use for commercial, advertising, editorial, or promotional purposes is subject to the prior authorization of the holder of the relevant rights.

Clients may take photographs for strictly personal use, provided they respect the privacy of other Clients, staff, and third parties, and comply with the stay rules set out in these Terms and Conditions.

Photo shoots, filming, and the production of professional or commercial content remain subject to prior written authorization from Laplace in accordance with Article 16.

ARTICLE 48 – AMENDMENT OF TERMS AND CONDITIONS OF SALE

Laplace may modify these Terms and Conditions, particularly to reflect changes in its services, organization, or applicable regulations.

The version binding on the Client is the one that was communicated to them or was accessible at the time their booking was concluded.

Subsequent changes to the Terms and Conditions do not retroactively alter the contractual terms of a booking already concluded, unless such changes result from mandatory legal provisions that are immediately applicable.

The date of the last update appears at the beginning of these Terms and Conditions.

ARTICLE 49 – PARTIAL INVALIDITY

If any provision of these Terms and Conditions is declared void, illegal, unenforceable, or inapplicable by a legal provision or a final decision of a competent court, the remaining provisions shall remain in full force and effect.

The provision in question shall, as far as possible, be interpreted or replaced in a manner that preserves the general intent of the contract in compliance with applicable regulations.

ARTICLE 50 – NON-WAIVER

The fact that Laplace or the Client does not exercise any of the provisions of these Terms and Conditions at any given time shall not be interpreted as a waiver of the right to enforce them subsequently.

ARTICLE 51 – GOVERNING LAW

These Terms and Conditions and any contracts concluded between Laplace and the Client are governed by French law.

Where the Client is a consumer residing in another state, this provision shall not deprive them of the protection afforded by the mandatory provisions applicable under the relevant regulations.

ARTICLE 52 – DISPUTE RESOLUTION

In the event of a dispute regarding a booking, a service, or these Terms and Conditions, the Client is invited to first submit a written complaint to Laplace in accordance with Article 41 in order to seek an amicable solution.

When the Client is a consumer, they may subsequently use the consumer mediation process mentioned in Article 42.

In the absence of an amicable resolution, the dispute may be brought before the competent court determined in accordance with applicable legal rules.

No provision in these Terms and Conditions shall deprive a consumer Client of the mandatory jurisdictional rules from which they benefit.
